디즈니 계약서 상세분석 : 김수현 배상금

내용:

 

 

1. 이게 김수현이 감당해야할 계약조항임(moral Moral Clause) : 품위유지의무

If at any time during the Term,

1) Artist shall commit any act or become involved in any situation or occurrence which subjects Artist to public scandal, disrepute, widespread contempt, or public ridicule,

2) or which may shock, insult, or offend a significant portion of the community or public, or reflects unfavorably upon the reputation or public image of the Company

( including but not limited 1)to criminal conduct, 2)allegations of misconduct, or 3)association with individuals involved in such),

3) the Company shall have the right to immediately terminate this Agreement upon written notice, and Artist shall forfeit any unpaid compensation and may be held liable for any damages arising therefrom, including reputational harm and production losses.

2. 저 계약서 내용으로 보면

1) 굳히 형사사건으로 입건되지 않더라도 

2)  allegations of misconduct : 즉 의혹만으로 품위유지의무 조항에 걸림

김새론과 지금 김수현이 현재 의혹단계이고, 소송(명예훼손)이 진행중인데

소송의 결과와는 상관없이 이미 광범위한 의혹만으로도 걸린다는 것임

결국 김수현은 기자회견을 하지 말고 끝까지 이 악물고 무대응했어야지

그것 때문에 allegation에 걸리거든 ( 본인이 인정한거 아니야 그 의혹을 )

3) a ssociation with individuals involved in such : 연루되어 있다면

3번은 김수현이 아니라김수현 소속사가 주가조작, 탈세와 연관되어 있다면

계약을 해지하고 손해배상을 해야한다는 갓임

3. 그럼 예상 시나리오는?

1) 주가조작, 탈세 수사중인 상태 : (이것은 이미 확정, 기사가 났으니까)

계약정지 / 방송지연으로 생긴 피해보상 : 30-70억 (지금 이 돈을 물어줘야함.)

2) 수사 결과까지 나오면 : 130 - 250억

김수현 교체, 다른 배우로 재촬영 (촬영비는 김수현측이 부담)

김수현 기획사가 수사결과 의혹에 개입되거나 시세조작 불법행위와 연관이 밝혀진다면

3) 기획사가 유죄판결 받으면(주가조작, 탈세로) : 280억 - 450억원

결론 : 

소속사 주가 조작 때문에

김수현은 넉오프에서 교체되거나

아니면 넉오프가 폐기처분될거라는 것임 ㅎ
