The legal feud between OpenAI CEO Sam Altman and Tesla CEO Elon Musk has escalated as OpenAI has filed a countersuit against Musk, alleging that his efforts to block the company's transition to a for-profit entity were part of a series of "malicious tactics" aimed at undermining the AI firm. The lawsuit, filed in the U.S. District Court for the Northern District of California, accuses Musk of attempting to destroy OpenAI through various means, including media attacks, social media campaigns, and baseless demands for corporate documentation.
OpenAI claims that Musk's actions are intended to harm the company and include a "fake acquisition attempt" meant to seize OpenAI's assets. In February, Musk, leading an investor consortium, offered to buy a controlling stake in OpenAI for $97.4 billion, a figure significantly lower than OpenAI's current valuation of $300 billion. OpenAI has labeled this offer as a strategic ploy to disrupt its operations.
"Musk continues to use malicious tactics to slow OpenAI's growth for his own personal gain," OpenAI stated. "These efforts are anti-competitive and illegal, and we have filed a countersuit to prevent them." The company has requested the court to halt Musk's actions and hold him accountable for damages incurred.
Musk, who was an initial investor in OpenAI in 2015, left the company in 2018 and divested his shares. Following the global success of OpenAI's ChatGPT, Musk filed a lawsuit last year, alleging that OpenAI's conversion to a for-profit entity breached its original non-profit promise and investor agreements.
The case is expected to go to a jury trial in the spring of next year, according to Reuters.
